TICKET TERMS & CONDITIONS
This ticket is a revocable license issued by Northeastern State University (“NSU”) for admission to the event identified on the ticket. By purchasing, accepting, possessing, presenting, or using this ticket, the ticket holder agrees to these Terms & Conditions and all applicable University, conference, NCAA, venue, and governmental policies and regulations.
1. ALL SALES ARE FINAL
ALL TICKET SALES ARE FINAL. NO REFUNDS, RETURNS, OR EXCHANGES WILL BE ISSUED EXCEPT AS EXPRESSLY PROVIDED BY NORTHEASTERN STATE UNIVERSITY.
Event dates, starting times, opponents, locations, and gate-opening times are subject to change. A change in the date, time, opponent, or other event details does not entitle the ticket holder to a refund.
If an event is postponed or rescheduled, the original ticket will generally be honored for the rescheduled event, subject to University policy. No refund will be provided if the ticket holder is unable or chooses not to attend the rescheduled event.
If an event is cancelled and not rescheduled, any remedy, credit, or refund will be determined solely by Northeastern State University in accordance with applicable University policy.
2. AUTHORIZED TICKET SALES
Tickets are issued and sold only by Northeastern State University Athletics or its designated ticketing agents and authorized partners.
Tickets obtained from unauthorized sources may be counterfeit, lost, stolen, duplicated, or otherwise invalid and may not be honored. Any person purchasing or acquiring tickets from an unauthorized source assumes all risks associated with that transaction.
NSU Athletics reserves the right to revoke tickets obtained or used in violation of University policies or these Terms & Conditions.
3. REVOCABLE LICENSE
This ticket grants the holder a limited and revocable license to enter the designated venue and attend the specified event from the location, section, or seating area authorized by the ticket.
NSU Athletics reserves the right to revoke this license, deny admission, or remove any person from an Athletics venue for violation of these Terms & Conditions, University policies, venue rules, or applicable federal, state, or local law.
Unless otherwise required by law or expressly authorized by the University, removal or revocation for violation of these terms will occur without refund.
4. LOST, STOLEN, DESTROYED, OR DUPLICATED TICKETS
Once delivered, tickets are the responsibility of the ticket holder. NSU Athletics is not responsible for lost, stolen, destroyed, duplicated, or otherwise compromised tickets.
NSU Athletics reserves the right to determine whether a replacement ticket or credential will be issued.
5. ENTRY AND RE-ENTRY
A valid ticket or approved credential is required for admission to ticketed NSU Athletics events.
Unless otherwise announced for a specific event or venue, patrons who leave the venue after admission must obtain a new valid ticket to re-enter.
Event-specific age restrictions, admission requirements, and ticket requirements may apply.
6. SECURITY SCREENING
For the safety of student-athletes, coaches, officials, employees, guests, and spectators, all persons and belongings entering an NSU Athletics venue may be subject to security screening.
Security measures may include, but are not limited to, security personnel, bag inspection, metal detector screening, restrictions on hand-carried items, and other measures deemed reasonable and appropriate by Northeastern State University.
Refusal to comply with required security procedures may result in denial of admission without refund.
7. BAGS AND PROHIBITED ITEMS
NSU Athletics may establish clear-bag requirements, bag-size restrictions, and prohibited-item policies for its venues and events. All ticket holders are responsible for reviewing and complying with the policies applicable to the specific venue or event.
Prohibited items may include, but are not limited to, outside food or beverages, coolers, cans, bottles, unauthorized noisemakers, fireworks, oversized stadium seats, unauthorized video or recording equipment, weapons prohibited by law or University policy, and other items determined by NSU to present a safety, security, operational, or event-management concern.
Medically necessary items and diaper bags may be subject to inspection. Service animals are permitted as required by applicable law and University policy.
NSU reserves the right to modify prohibited-item and security policies when reasonably necessary for safety, security, or event operations.
8. FAN CONDUCT
Ticket holders and guests are expected to conduct themselves in a safe, respectful, and sportsmanlike manner.
Unauthorized solicitation, disruptive behavior, fighting, threatening or abusive conduct, throwing objects onto the playing surface or into spectator areas, attempting to enter restricted areas, interfering with participants or event operations, and violations of University policy or applicable law are prohibited.
NSU Athletics reserves the right to deny admission, eject a patron, or revoke ticket privileges for conduct that threatens safety, disrupts the event, interferes with the enjoyment of other guests, or violates applicable rules or laws.
9. SIGNS, BANNERS, AND PROMOTIONAL MATERIALS
Signs, banners, placards, leaflets, promotional materials, and similar items may be restricted or prohibited based on venue and event requirements.
NSU Athletics reserves the right to prohibit any item that obstructs sightlines, interferes with event operations, creates a safety concern, contains commercial advertising or unauthorized solicitation, or otherwise violates University policy.
10. COMMERCIAL AND PROMOTIONAL USE
This ticket may not be used for advertising, promotions, contests, sweepstakes, giveaways, fundraising, resale promotions, or other commercial or trade purposes without the prior written authorization of Northeastern State University.
11. RECORDING AND TRANSMISSION
Unauthorized commercial recording, reproduction, transmission, livestreaming, distribution, or other use of an NSU Athletics event or portions thereof may be prohibited.
Any photography, video, audio, data collection, livestreaming, or other recording or transmission is subject to applicable Northeastern State University, NCAA, Mid-America Intercollegiate Athletics Association (“MIAA”), media-rights, and event policies.
12. ASSUMPTION OF RISK
The ticket holder voluntarily assumes all risks and dangers incidental to or associated with attendance at an athletic event, whether occurring before, during, or after the event, to the fullest extent permitted by applicable law.
13. PUBLICITY RIGHTS
By entering an NSU Athletics event, the ticket holder acknowledges that photographs, video recordings, audio recordings, livestreams, broadcasts, or other recordings may be made during the event.
To the fullest extent permitted by law, the ticket holder grants Northeastern State University, the MIAA when applicable, and their authorized designees permission to use the ticket holder's voice, image, and likeness captured in connection with the event in any media for legitimate University, conference, promotional, advertising, archival, broadcast, or commercial purposes without further permission or compensation.
14. NCAA RULES
Ticket holders are subject to applicable NCAA rules and regulations.
NCAA legislation prohibits institutional employees, representatives of athletics interests, and others from providing prospective student-athletes, student-athletes, or their friends or relatives with benefits or special arrangements not authorized by NCAA rules.
Use of an NSU Athletics ticket in a manner that violates NCAA legislation or University policy may result in cancellation or revocation of ticket privileges.
MIAA REGULAR-SEASON AND POST-SEASON EVENT TERMS
For any event governed by the Mid-America Intercollegiate Athletics Association (“MIAA”), the ticket holder is additionally subject to applicable MIAA ticket terms and conditions.
Presenting or using a ticket to attend an MIAA event or affiliated activity constitutes the ticket holder's agreement to applicable MIAA terms, including limitations of liability and remedies, assumption of risk, publicity rights, releases, indemnification provisions, and other conference requirements.
In the event of a conflict between applicable MIAA Ticket Terms and institutional terms, the MIAA Ticket Terms shall control with respect to the MIAA, while Northeastern State University policies and these Terms & Conditions shall control with respect to the University to the extent provided by applicable law and conference policy.
15. MIAA EVENT CHANGES, CANCELLATIONS, AND REMEDIES
For an MIAA event, the sole and exclusive remedy available to the holder of a valid ticket if admission is refused or withdrawn, or if an event is cancelled and not rescheduled, shall be governed by the policies of Northeastern State University as the hosting institution.
The ticket holder shall not be entitled to consequential, incidental, indirect, or exemplary damages of any kind from the MIAA. The MIAA's liability for any breach of the terms associated with the ticket shall not exceed the face value of the ticket.
THE DATE AND TIME OF AN EVENT AND THE OPENING OF THE GATES ARE SUBJECT TO CHANGE AT THE DISCRETION OF THE HOSTING INSTITUTION OR AS A RESULT OF CIRCUMSTANCES BEYOND THE CONTROL OF THE HOSTING INSTITUTION OR THE MIAA. NO REFUND OR OTHER REMEDY WILL BE PROVIDED BECAUSE A TICKET HOLDER CANNOT OR CHOOSES NOT TO ATTEND A RESCHEDULED EVENT.
16. MIAA PUBLICITY GRANT AND WORKS LICENSE
For MIAA events, the ticket holder grants the MIAA, its member institutions, and their respective authorized designees permission to use the ticket holder's voice, image, and/or likeness captured in connection with the event in media now existing or developed in the future, including for promotional and commercial purposes, without further permission or compensation, to the fullest extent permitted by law.
Unauthorized transmission or distribution for commercial purposes, and unauthorized public performance or display of photographs, images, video, livestreams, accounts, descriptions, or other works created from an MIAA event, may be prohibited under applicable MIAA policies and media-rights agreements.
17. MIAA WAIVER AND RELEASE
To the fullest extent permitted by applicable law, the ticket holder acknowledges and accepts the assumption-of-risk, waiver, and release provisions established by the MIAA for its regular-season and postseason events.
Such provisions may include releases of the MIAA, its employees, officers, members, affiliates, agents, representatives, successors and assigns; MIAA member institutions; and their respective directors, officers, employees, agents, coaches, players, participants, volunteers, administrators, and independent contractors from claims arising out of or relating to attendance at MIAA events, including claims involving injury, illness, or death, to the extent permitted by applicable law.
The ticket holder further acknowledges that applicable MIAA releases may address exposure to or contraction of communicable or infectious diseases arising from attendance at an event.
18. MIAA INDEMNITY AND HOLD HARMLESS
To the fullest extent permitted by applicable law and applicable MIAA policy, the ticket holder agrees to the defense, indemnification, and hold-harmless provisions contained within the MIAA Ticket Terms with respect to claims, liabilities, losses, damages, expenses, or other obligations arising from the ticket holder's conduct or use of tickets to attend an MIAA event.
19. SEVERABILITY
These Terms & Conditions are intended to be separable and severable.
If any provision or portion of these Terms & Conditions is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain in effect to the fullest extent permitted by law.
Any invalid or unenforceable provision shall be construed, limited, or reformed to the minimum extent necessary to make the provision enforceable where permitted by applicable law.
20. ACCEPTANCE OF TERMS
By purchasing, accepting, possessing, presenting, or using an NSU Athletics ticket, the ticket holder acknowledges and agrees to these Terms & Conditions, applicable Northeastern State University policies, and, when applicable, NCAA and MIAA policies and ticket terms.
The ticket holder is responsible for ensuring that any person to whom the ticket is transferred is aware of and complies with these Terms & Conditions.
ALL SALES ARE FINAL.
Northeastern State University Athletics reserves the right to modify these Terms & Conditions, venue policies, security procedures, and event requirements when reasonably necessary and as permitted by applicable law.
